USER AGREEMENT OF INTIS AUCTION PVT LTD.,

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. 

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.intis.in website.     

Terms & Conditions for Participating in INTIS AUCTIONS Pvt Ltd.,



1. Sale is on "AS IS WHERE IS BASIS" condition and "NO COMPLAINT BASIS".

2. To become a registered buyer in Intis Auctions Pvt Ltd., interested buyers to submit all the required Self attested KYC documents such as ID Proof, Address Proof & Business Proof, along with a Registration Fee of ₹.8500 plus applicable 18% GST Tax. Apart from the annual Schemes we do provide the following exciting Schemes, which can be suited for your convenience Silver/Gold/Platinum/Diamond/Lifetime Schemes. For further details please contact our support executives.

3. All auctions are done for registered & pre-approved closed user group only.

4. Auctions Schedules are intimated in advance to buyers through any one of the means, SMS/Tele Calling/emails/Post/Direct meeting.

5. Auction Catalogues with all product/contact information, based on seller inputs are put in the site ww.Intis.in, to facilitate buyer interest & inspections.

6. Product Inspection is mandatory. Bidding without inspections is at bidder's risk.

7. The Bidders cannot retract from their offers. If done so, the Bidder will be delisted from the buyer community of Intis Auctions Pvt ltd.

8. Delivery will be ex-SELLER warehouse.

9. On confirmation of the price, the Winning Bidder should make 100% payment immediately within 48 hours or within the time specified by the SELLER.

10. Seller reserves the right to accept or reject the Winning bid.

11. Any other terms & Conditions as per SELLER / Intis Auctions Pvt Ltd., will be applicable.

Important :

All auctions will be conducted with EMD's from the participating buyers. The EMD may vary as per seller requirements. Registered Buyers agree that they would follow the payment terms laid by the auction company and the seller. In case buyers default on the payment terms, the seller reserves the right to forfeit the EMD paid for that particular auction. Hence buyers agree that they would make all approved payments within the specified time frame as per seller terms and conditions. All forfeited EMD's taken on the seller name will be forfeited to the seller. The buyer indemnifies Intis Auctions Pvt Ltd, against any disputes with the seller on EMD forfeiture and other related issues.

11. Intis Auctions Pvt Ltd., will not be responsible for any other problem directly or indirectly affecting the auctions.                              



Intis Auctions Pvt ltd., takes no responsibility of the quality, quantity, documentation details of buyers/sellers. Both the buyers & sellers agree to defend indemnity and hold harmless. Intis Auctions Pvt Ltd., from any loss, damage, cost and expenses caused by any reason during this transaction. In no event shall Intis Auctions Pvt Ltd., be liable for any loss for the transactions by business, revenues, profit, costs direct and incidental, consequential or punitive damages of any claim. Both the parties agree to have discussed all the related matter regarding this transaction and have understood in full that Intis Auctions Pvt Ltd., has provided a source of supply and has nothing to do any further especially with regards to quality, warranty, guarantees, delivery schedules, payments, rejections, transportation, legal laws and regulations to be followed from time to time etc. Since Intis Auctions Pvt Ltd., does not possess knowledge base of the commodities under transaction both the parties agree that the matter contained in the materials as a part or as a whole does not violate any applicable law.         

The information, software, products, and services included in or available through Intis Auctions Pvt Ltd., sites/services may include inaccuracies or typographical errors. Changes are periodically made to the Intis Auctions Pvt Ltd., sites/services and to the information therein. Intis Auctions Pvt Ltd., and/or its respective suppliers may make improvements and/or changes in the Intis Auctions Pvt Ltd., sites/services at any time. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. When you register with Intis, we ask for your name, email address, birth date, telephone number, company name, PAN number and contact address.

Intis also automatically receives and records information on its server logs from your browser including your IP address.

Intis uses information for two general purposes: To fulfill your requests for certain products and services, and to contact you about Intis auctions.                             

Information Sharing and Disclosure:

Intis will not sell or rent your personally identifiable information to anyone. 

Intis will send personally identifiable information about you to other companies or people when:  

i] We have your consent to share the information;

ii] We need to share your information to provide the product or service you have requested;

iii] We need to share the information with certain service partners in order to respond to your comments or to resolve service issues. (Unless we tell you differently, these partners have no independent right to use this information except to respond to your comments or to resolve the service issues.);

iv] We respond to requests from any Indian or foreign government, security, defence, revenue, regulatory or other authority, agency or officer;

v] We respond to subpoenas, court orders or legal process; or 

vi] We find that your actions on our web sites violate the Intis User Agreement or any of our usage guidelines for specific products or services.

Your Intis Account Information is password-protected for your privacy and security. In certain areas Intis uses industry-standard SSL-encryption to protect data transmissions.  

Changes to this Privacy Policy:

Intis may amend this policy from time to time. If we make any substantial changes in the way we use your personal information we will notify you by posting a prominent announcement on our site.

INTIS User Performance Guarantee Policy

1. You hereby agree that in order to be eligible to bid/buy, You shall deposit  with INTIS AUCTIONS PRIVATE LTD an amount of ₹.10,000/- (Indian Rupees Ten Thousand only) or such additional amount, as dependent on your adherence with  www.intis.in (herein after Intis Platform) User Agreement as already agreed between You and INTIS AUCTIONS PRIVATE LTD (hereinafter INTIS) and as indicated in the INTIS Platform sellers terms and conditions and auction calendar or as may be separately communicated to you in any manner. INTIS will inform you of such additional amount to be deposited by you and you shall deposit the same within the period indicated, If for any reason whatsoever You fail to deposit the said amount within the time indicated, INTIS may at its sole discretion disallow or restrict you from participating in any transactions on the INTIS Platform.           

2. Intis Auctions Private Limited shall send you an electronic acknowledgement of the receipt of the Performance Guarantee.      

3. Performance Guarantee may be forfeited as liquidated damages to Intis Auctions Private Limited in the event you breach any of the terms and conditions of INTIS Platform User Agreement and/or terms and conditions as indicated by INTIS Platform sellers' ("Event of Breach"). You agree that such forfeiture as liquidated damages is fair and reasonable compensation to Intis Auctions Private Limited for all the direct and special losses, costs and damages incurred or suffered / may be incurred or may be suffered by Intis Auctions Private Ltd including loss of the fees from seller due to one or more Event of Breach.    

4. Intis Auctions Private Ltd shall inform You the Event of Breach and will seize the Performance Guarantee.

5. You shall be entitled to the refund of the Performance Guarantee from Intis Auctions  Private Limited (if the Performance Guarantee is not forfeited / liable to be forfeited / any Event of Breach has not occurred) upon Your voluntary termination of Your membership / registration on INTIS auctions Platform.

6. Intis Auctions Private Limited shall have the right to assign the terms of this policy and the Performance Guarantee in favor of an affiliate of Intis Auctions Private Limited and shall inform You of such assignment.

7. Deposit of Performance Guarantee and/or participation shall be deemed to be Your unconditional acceptance of this policy.                              

8. Nothing in this policy shall be construed as creating a partnership or joint venture of any kind between the parties or as constituting or authorizing either party as the agent of the other party for any purpose whatsoever. Neither party shall have the authority or power to bind the other, or to contract in the name of, or hold itself out as, or create a liability against the other in any way or for any purpose. No forbearance, indulgence or relaxation or inaction by any party at any time, to require performance of any of the provisions of this policy shall, in any way, affect, diminish or prejudice the right of such party to require performance of that provision at a later stage. If any provision of this policy is or is held to be invalid or unenforceable to any extent, the remainder of this policy shall not be affected thereby, and each provision of this policy shall be valid and enforceable to the fullest extent permitted by law. Any invalid or unenforceable provision of this policy shall be replaced with a provision, which is valid and enforceable and most nearly reflecting the original intent of the unenforceable provision.

9. This policy contains the entire agreement / understanding between the parties relating to the subject matter covered in the policy and supersedes any previous agreements, arrangements, undertakings, negotiations, discussions or proposals, written or oral, between the parties in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of the policy. Each party confirms that, in agreeing to enter into the policy, it has not relied on any statement, representation, warranty, understanding, undertaking, promise or assurance (whether negligently or innocently made) of any person save insofar as the same has expressly been made in this policy and agrees that it shall have no remedy in respect of any misrepresentation which has not become a term of this policy.

10. This policy shall be governed by and construed in accordance with the laws of India. All disputes, claims arising out of this policy shall be subject to the exclusive jurisdiction of the Courts at Chennai.

                                

Buyer Behaviour clause

1. Use of the INTIS Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the INTIS Website. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the INTIS Website and shall not sell, purchase or bid for any items on the INTIS Website. As a minor if you wish to purchase or sell an item on the INTIS Website such purchase or sale may be made by your legal guardian or parents who have registered as users of the INTIS Website. INTIS reserves the right to terminate your membership and refuse to provide you with access to the INTIS Website if it is brought to INTIS notice or if it is discovered that you are under the age of 18 years.

2. If you use the INTIS Website, you are responsible for maintaining the confidentiality of your User ID and Password and for restricting access to your computer, computer system and computer network, and you are responsible for all activities that occur under your User ID and Password.

3. Opening with the same User ID and Password in multiple browser lead to log out/ abort with any browser. INTIS will not take any responsibility on these kind of activties.

4. You agreed to:

  a.Provide true, accurate, current and complete information about yourself as prompted by INTIS registration form (such information being the "Registration Data")

  b.You must not include any of your contact details such as email addresses etc in your User ID; and

Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or INTIS has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the INTIS User Agreement, INTIS has the right to indefinitely suspend or terminate your membership with the INTIS Website and refuse to provide you with access to the INTIS Website.                                

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.intis.in website.

5. Withdrawal of bidding / purchasing rights:

All bids (under the auction format) and all purchases (under the Buy It Now format) on the INTIS  site are a firm commitment to purchase. If you are the purchaser / highest bidder for any item and your purchase / bid is accepted by the seller ("Winning buyer"), you are obligated to complete the transaction with the seller. Further, as a Winning buyer you must complete the transaction as per the seller process.

6. Non fulfillment of purchase commitment of the winning item by you could result in withdrawal of your bidding / buying rights. INTIS reserves a discretionary right to suspend and/or terminate your membership and refuse to provide you with access to the INTIS site.                               

This Include:

a) After winning the material/item, YOU will follow the disciplined purchase commitment with seller.

1. Once you receive the sale intimation letter, You can approach the seller with necessary documents (PAN no/TIN no/ Identity proof of yours, PCB certificate (if required) etc.) If you are authorizing any person for making the payment and lifting the material, you have to submit the authorization letter with identity proof of nominated person.              

2. After that you/authorized person will enter a sale contract/agreement with seller depends upon the material/items.

3. This sale contract/agreement will be mutually agreed and signed by both parties. (Seller and buyer)

4.You will make the Payment in advance by way of DD/RTGS. No Short payments and adjustment of EMD/security deposit with respect to short payment shall be allowed.

5. Place the truck on specific time as per the seller instruction. Wherever applicable, the weight as communicated in the weighbridge at seller place or on a public weighbridge of the seller choice shall be deemed as final and no dispute whatsoever will be entertained on this account. The weighment shall be made in the presence of seller/ Purchaser representative and will be considered as final / binding on both the Parties. Also, wherever applicable, the quantity in terms of numbers of meters, etc. will be declared by seller / Purchaser representatives and this will be considered as final and the successful bidder/s shall not lodge any dispute whatsoever on the above account.

6. You agree to go by the wages act for your labors/contract workers.

7. Your workmen agents or representatives shall not commit any nuisance, theft or indulge in 

Any anti social activities in the premises and you shall be liable for the good conduct safety 

And discipline of your workmen. In case of any such activity, delivery will be suspended and strict action as per law will be taken including forfeiture of EMD/SD/ .

8. The material /item delivery is as per seller instruction/process.

How to register as a seller in Intis Auctions?: To become a seller, one has get into a agreement with Intis Auction Pvt ltd, wherein the Terms & conditions along with the commercials are agreed and signed from both the sides.
Intis Auction Process: The Auction Process has three parts; Pre-Auction Process – In this phase the saleable product list given by the seller is put in the Intis auction calendar, clearly mentioning the seller name, date and time of the auction, along with the contact persons details of the seller & Intis. The buyers are intimated of the scheduled auction thru any of the following modes, sms, emails, telecalling & personal meeting. A calender invite is sent to the seller on the auction schedule. In this pre-auction process, the buyers have to physically inspect all the available products for disposals. The inspection process is mandatory. The sellers need to facilitate the inspection process properly so that all the interested buyers are able to inspect the products available for disposals.; During Auction Process – In this phase, the buyers need to login to the auction using their user id and password and start bidding for the products they are interested in. The permission to auctions is seller dependant, hence whichever buyers satisfies the conditions laid down by the sellers will be allowed to participate in the auctions. Buyers cannot back track on the bids placed, all bids are legally binding, hence while bidding, buyers have to be very careful on what they are bidding. The auction starts at a specific time in a given day and ends at the specific time in a sequence. The winners are declared on completion of the auction.; Post Auction Process – In this phase, the winning buyers are to make the payments of the products they have won as per the sellers payment terms. The available seller documents are released to the buyers by the sellers within the agreed time frame between the buyer and the seller. All buyer defaults would be viewed seriously and action would be taken against defaulting buyers, like forfeiting their emds, delisting them from future auctions etc., the products are released by the sellers to the winning buyers in their yards. Any dispute on the documents/products to be settled mutually by the seller and the buyers.
